TechUp Monthly Giveaway – Terms & Conditions

These Terms and Conditions apply to the TechUp Monthly Tech Giveaway operated through TechUp New Zealand.
By entering a monthly giveaway, entrants agree to these Terms and Conditions.
1. Promoter

2. Eligibility
Entry is open to New Zealand residents aged 18 years or older.
Employees, contractors and directors of TechUp, together with members of their immediate families or households, are not eligible to enter.
Entrants must provide accurate contact information and may be required to confirm their age and New Zealand residency before receiving a prize.
3. Giveaway Period
Unless TechUp publishes different dates for a particular monthly giveaway, each giveaway:
- Opens at 12:00 AM New Zealand time on the first calendar day of the month
- Closes at 11:59 PM New Zealand time on the final calendar day of the same month
Entries received outside the applicable giveaway period will not be included in that month’s draw.
TechUp will publish the applicable entry period and expected draw date with each monthly prize announcement.
4. Ways to Enter
There are two ways to enter the TechUp Monthly Tech Giveaway.
4.1 Entry Through an Eligible TechUp.nz Order
Each eligible order placed directly through TechUp.nz during the applicable giveaway period receives one entry.
One eligible order provides one entry, regardless of:
- The number of products in the order
- The total value of the order
- The number of units purchased
Separate eligible orders receive separate entries.
To qualify, an order must:
- Be placed directly through TechUp.nz
- Be successfully paid
- Be placed during the applicable giveaway period
- Not have been cancelled, charged back, fully refunded or identified as fraudulent before the draw
Orders placed through Trade Me, eBay, Reebelo, Kogan or any other third-party marketplace are not eligible unless expressly stated in the relevant giveaway announcement.
4.2 Free Subscriber Entry
Each unique active TechUp email subscriber receives one free entry into each monthly giveaway.
No purchase is required for the subscriber entry method.
To qualify for a subscriber entry, the entrant must:
- Have provided a valid email address
- Be actively subscribed to TechUp marketing emails when the giveaway period closes
- Meet the eligibility requirements in these Terms and Conditions
Existing active subscribers are automatically eligible and do not need to subscribe again each month.
Multiple subscriptions using the same email address will count as one subscriber entry.
A person who unsubscribes before the monthly entry period closes will not receive a subscriber entry for that draw. Unsubscribing after the draw has closed will not remove an entry that was already validly received.
Subscribers may unsubscribe from marketing communications at any time.
5. Multiple Entries
An eligible entrant may receive:
- One entry for being an active subscriber
- One additional entry for each eligible TechUp.nz order placed during the giveaway period
For example, an active subscriber who places two eligible website orders during the month will receive three entries:
- One subscriber entry
- Two order entries
Creating multiple email subscriptions for the same person does not provide additional subscriber entries.
6. No Additional Entry Charge
There is no separate charge to enter the giveaway.
Products purchased through TechUp.nz are sold at their ordinary advertised prices. TechUp will not add an entry fee or increase the product price solely because the product is associated with the giveaway.
7. Monthly Prize
One winner will receive the prize advertised for the applicable monthly giveaway.
Before each giveaway opens, TechUp will publish:
- The exact product or prize
- Brand and model
- Storage capacity or other important specifications
- Colour, where applicable
- Condition, such as Brand New, Open Box, Pre-Owned or Refurbished
- Cosmetic condition grade, where applicable
- The approximate New Zealand retail value
- Any accessories included with the prize
The advertised prize will be reserved for that monthly giveaway.
The prize cannot be:
- Exchanged for cash
- Exchanged for store credit
- Transferred to another person
- Exchanged for a different model, colour or product
unless TechUp expressly agrees otherwise in writing.
New Zealand law requires participants to be informed of the retail value and characteristics of a non-cash prize. The prize should therefore not be described only as an unspecified device selected later according to stock availability.
8. How the Draw Is Conducted
The monthly winner will be selected entirely at random after the applicable entry period has closed.
TechUp will:
- Export all potentially eligible TechUp.nz orders for the giveaway period.
- Remove cancelled, fully refunded, unpaid, chargeback, fraudulent and otherwise ineligible orders.
- Export the list of active email subscribers as at the closing time.
- Remove duplicate subscriber email addresses and ineligible subscriber records.
- Create one entry row for each eligible website order.
- Create one entry row for each unique eligible subscriber.
- Combine the order and subscriber entries into one master draw sheet.
- Assign each entry a unique sequential number.
- Use a spreadsheet random-number formula or equivalent computer-generated random selection method to select one entry number.
- Match the selected number to the corresponding entry in the master draw sheet.
The giveaway is conducted as a lottery: all eligible entries are finalised before the winning entry is randomly selected. This format is important for online sales promotions involving chance.
9. Draw Records and Verification
TechUp will retain a dated record of:
- The final eligible order-entry list
- The final eligible subscriber-entry list
- The combined master draw sheet
- The total number of eligible entries
- The selected random number
- The date the draw was conducted
- The provisional winner
- Any redraw that was required
After the random number has been generated, the result will be saved as a fixed value so it cannot change through spreadsheet recalculation.
The selected entrant will be treated as the provisional winner until their eligibility has been verified.
10. Winner Notification
The provisional winner will be contacted using the email address or contact information associated with their selected entry.
TechUp may ask the provisional winner to confirm:
- Their full name
- Their age
- Their New Zealand residency
- Their delivery address
- Their subscriber email address or order information
- Any other information reasonably required to confirm eligibility
The provisional winner must respond within seven calendar days of TechUp’s first notification.
11. Redraw
TechUp may conduct another random draw from the remaining eligible entries if the provisional winner:
- Cannot be contacted
- Does not respond within seven calendar days
- Does not meet the eligibility requirements
- Supplies false, incomplete or misleading information
- Declines the prize
- Is otherwise disqualified under these Terms and Conditions
The redraw will be conducted using the same random-selection process as the original draw.
12. Prize Delivery or Collection
TechUp will arrange delivery of the prize to an eligible New Zealand address at no charge to the winner.
Auckland-based winners may be offered the option to collect the prize by appointment from TechUp’s Auckland facility.
The winner will not be required to pay an additional shipping or collection charge to receive the prize.
The winner is responsible for providing a complete and accurate delivery address.
13. Public Winner Announcement
TechUp may announce the winner using limited information, such as:
- The winner’s first name
- The winner’s city or region
- The prize won
- The month of the giveaway
TechUp will not publish the winner’s email address, telephone number, street address or order information.
Photographs, videos, testimonials or additional identifying information will only be published with the winner’s separate permission.
Accepting the prize does not require the winner to provide a photograph, video or testimonial.
14. Privacy
TechUp may use personal information collected through customer orders and subscriber records to:
- Administer the giveaway
- Validate entries
- Conduct the random draw
- Contact and verify a provisional winner
- Arrange prize delivery
- Maintain appropriate giveaway records
- Announce the winner as described in these Terms
Subscriber information will also be used for marketing communications where the individual has subscribed to receive them.
TechUp will handle personal information in accordance with the Privacy Act 2020 and its Privacy Policy.
Individuals may request access to or correction of their personal information by contacting support@techup.nz.
Businesses must tell people why personal information is being collected and how it will be used. Your newsletter form and Privacy Policy should therefore clearly mention entry into monthly giveaways.
15. Disqualification
TechUp may disqualify an entry where it reasonably believes that:
- The entry is fraudulent or automated
- False information has been provided
- An order was placed without a genuine intention to complete the purchase
- Multiple subscriber identities were created to obtain additional entries
- The entrant has interfered with the entry or draw process
- The entrant does not meet these Terms and Conditions
Disqualification decisions will be based on reasonable evidence and applied consistently.
16. Technical Problems
TechUp is not responsible for entries that are not received because of a technical error outside its reasonable control.
Where a valid order or subscription was received during the giveaway period but was accidentally omitted because of a TechUp processing error, TechUp will take reasonable steps to correct the error before the draw where possible.
17. Changes, Suspension or Cancellation
TechUp may update these Terms and Conditions for future monthly giveaways.
Any material change will apply from a later giveaway period and will not ordinarily be applied retrospectively after a monthly giveaway has opened.
TechUp may suspend or cancel a giveaway where this becomes necessary because of:
- A legal or regulatory requirement
- Fraud or attempted manipulation
- A serious technical failure
- An event outside TechUp’s reasonable control that prevents the giveaway from being conducted fairly
Where reasonably possible, TechUp will publish an explanation and take steps that minimise disadvantage to valid entrants.
Competition conditions and relevant time limits must be clear, accurate and not misleading. TechUp should therefore avoid relying on an unrestricted right to change the prize or rules after entries have been accepted.
18. Consumer Rights
Nothing in these Terms and Conditions excludes, restricts or limits any rights that cannot legally be excluded under New Zealand law.
Winning or entering the giveaway does not affect a customer’s rights regarding products purchased from TechUp.
19. Promoter’s Decisions
TechUp’s decisions regarding entry validation and administration of the random draw are final, subject to applicable New Zealand law.
TechUp will consider genuine questions about eligibility, errors or administration in good faith.
